Can Severance Pay Pass to Heirs
Severance pay is money paid to those who leave a workplace as a senior employee. For a person to be eligible for severance pay, they must have worked in their position for at least one year and must have been employed under the Labor Law. The employer is required to pay severance pay if they terminate the contract with a notice of termination. If the employee's contract ends with a notice of termination for a fixed term, severance pay is not provided. Additionally, severance pay can be provided for reasons such as military service, retirement from their institution or union, or disability.
If the person who is supposed to receive severance pay dies without receiving it, it can be transferred to the surviving heir. Furthermore, female employees may have the right to receive severance pay if they terminate their contracts with a notice of termination within a fixed term starting from the date of their marriage due to marriage. However, if a person resigns before the aforementioned contract, severance pay is not paid.
